I would hope that Council refuses to consider any "Heritage" proposal that does not cost out a strog estimate on expected costs to carry out their "preservation plans".   Various groups can pontificate all they want with grandiose ideas---but it comes down to dollars and cents and a hit to the taxpayer.....unless there are defined grants to offset costs.

It was already decided in 1992 from the heritage committee at the time what was going on and the decisions for the cooper site and in writing. Here is a copy:

This is like listening to a native indian claim that everything is sacred burial space and should be saved.  For the love of god, this building is an eyesore, and at best a piece of it should be kept for some kind of memorial.  But get rid of it and move on.  Its not like its a functioning factory anymore.

Ryan wants another $25 million plus from city


The City of Stratford was served with a notice of arbitration and statement of claim this week seeking $25 million and a myriad of other demands on behalf of Ontario numbered company 1353837.

The principal owner of that company is Lawrence Ryan, former owner of the Cooper site building and property.

The city expropriated the property in 2009 and in January 2010 the city and Ryan inked an agreement giving the city possession of the former CNR lands, also known as the Cooper property.

The city paid $4.5 million ($3.9 million went to Republic Mortgage Investment Co.), an additional $150,000 in legal and consulting costs payable to Ryan and $60,000 towards relocation costs.

That transaction was the culmination of the city's expropriation of the property for the site of the new University of Waterloo Stratford Campus as well as for economic development.

However, despite the agreed upon price, the Expropriation Act allows the former owner to seek further compensation in an arbitration process before the Ontario Municipal Board.

The document delivered to the city this week chronicles the history of the downtown property dating back to the turn of the last century when it was a major repair centre for steam locomotives.

More specifically, it gives a history of the disputes between Ryan and the city beginning in 1996 when Ryan states he was hired as a project manager for the construction of a new hotel by previous owner Ray Jacobs.

The document says Ryan was paid $10,000 per month and would receive an additional $750,000 when the Stratford Resort and Spa was completed.

The scope of the Stratford Resort and Spa was massive - "an adaptive reuse of the remaining main heritage shops to include a 260-room hotel, a conference centre, spa, heritage cityscape atrium, soundstage dinner theatre, office space, retail space, events space, restaurants, a pub and fitness centre," said the statement of claim.

The project was not completed, or really started, by Jacobs, and Ryan gained control of the property from Jacobs in 1999. Ryan claims it was still his intent to proceed with the massive project or something similar, but the statement of claim alleges that a pattern of interference from the city and other government agencies in concert with the city prevented the Stratford Resort and Spa and subsequent proposals from becoming a reality.

The summary page states that the claimant, Ryan, is seeking $25 million for market value of the property. Additionally, part of a long list of demands includes a request for damages as the result of delays brought about by the city, damages as the result of business and income losses, replacement costs for the shops, compensation for executive and staff time, interest at 12% for all unpaid compensation dating back to 1996, an order to preserve evidence in the buildings and legal costs.

The next step in the process is for the city to reply with its position and then the OMB will hear the case.

"The city is taking the position that the $4.5 million already paid to Lawrence Ryan was fair compensation," said Stratford CAO Ron Shaw. "We believe it was fair and we will vigorously defend that position."

The numbered company of which Ryan is principal is represented by the Kitchener law firm Gowling Lafleur Henderson.

Yes, and it appears the city has a bad history with OMB hearings. I would be worried and ask more questions,... need input... the public must get involved before we all have to pay..
I have watched the fights back and forth for years the OMB costs were over a million to fight walmart  what is this one going to cost  and how much longer will it take to make a deal and start getting tax dollars instead of wasting them.
Litigation and legal fees add up quickly, with expropriation my understanding is that the city is responsible to pay all legal costs for both sides. I heard that is close to 2 million already, is there any documents on that?

If the people in power were responsible enough they would not allow this to happen to the citizen's and taxpayers. This is not the same as walmarts omb, it is serious matter that will take time, and I want to read the documents, and I will go to city hall to get the documents. I think the city needs to post it on there website and be more open to the public instead of hiding stuff, lying and passing the buck. I hope to see you at monday nights meeting, if anything comes out of it....
